- - - CIUDAD JUÁREZ, CHIHUAHUA; A DIECINUEVE DE ENERO DEL AÑO DOS MIL DOCE.- - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - Vistos los autos que integran el presente asunto a efectos de emitir la resolución definitiva correspondiente, se advierte de la instrumental de actuaciones la posibilidad de que exista Orden de Aprehensión librada en contra de la demandada JANET NIERI VILLAREAL por el delito de TRÁFICO DE MENORES, por lo que en atención superior del menor MIGUEL ANGEL RIVERA VILLAREAL, quien tiene derecho a convivir con ambos progenitores, con fundamento en lo dispuesto por el artículo 3 apartados 1 y 2, artículo 4, 5 y 9 apartados 1 y 2 de la Convención Sobre los Derechos del Niño, 3, 10, 12 inciso b) de la Ley para la Protección de los Derechos de Niños, Niñas y Adolescentes, que para salvaguardar los intereses de los menores faculta a los Órganos Jurisdiccionales a adoptar todas las medidas administrativas y sociales velando siempre por el interés del menor, como diligencia para mejor proveer y en base a las facultades concedidas por el artículo 265 del Código de Procedimientos Civiles, que faculta a los Tribunales a valerse de cualquier documento que sea que pertenezca a las partes o a un tercero, sin mas limitaciones que la de que las pruebas no estén prohibidas por la ley, a fin de conocer la verdad de los hechos controvertidos, por lo tanto, se estima pertinente girar oficio al Juez Séptimo de Distrito en ésta Ciudad Juárez, Chihuahua, a fin de que se sirva informar, de ser procedente, si bajo el número de expediente 2/11, mesa I, ha librado Orden de Aprehensión alguna en contra de JANET NIERI VILLAREAL, y en su caso, se sirva informar el motivo de dicho mandato.- - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -- - - - - - - - - - - - - - N O T I F I Q U E S E- - - - - - - - - - - - - - - - - - - - - - - - - - - - Así, lo acordó y firma la Licenciada PATRICIA MARTÍNEZ TÉLLEZ, Juez Cuarto de lo FAMILIAR del Distrito Judicial BRAVOS, en unión de la Secretaria de Acuerdos, con quien actúa y da fe.
