ACTA DE DENUNCIA CASO 2309 0022460 2010

En ciudad Juárez, chihuahua, a las 11 30 horas del 23 de enero de 2010 en la subprocuraduría de justicia zona norte ubicada en eje vial Juan Gabriel y aserraderos ante el agente del ministerio publico abogado Alma Patricia Villagrana Prospero y con fundamento en el articulo 213 tercer párrafo del código de procedimientos penales se reciba la denuncia del ciudadano Jorge Ramón Guadalupe Rivera López, originario de ciudad Juárez, soltero, de profesión catedrático universitario, acude con fundamento en los artículos 334 y 339 del código mencionado a presentar la siguiente DENUNCIA POR SUSTRACCION Y RETENCION ILICITA DE MENOR EN EL EXTRANJERO en perjuicio de mi hijo Miguel Ángel Rivera Villareal de 6 años de edad EN CONTRA DE JANET NIERI VILLAREAL por los siguientes hechos:
El 7 de abril de 2003 contraje matrimonio con Janet Nieri Villareal, durante el cual procreamos un hijo de nombre Miguel Ángel Rivera Villareal, pero con fecha de agosto 28 de 2009 causo ejecutoria la solicitud de divorcio voluntario que promovimos, en el cual ella conserva la custodia del menor y ambos compartimos la Patria Potestad teniendo yo el derecho de convivencia, visitar y llevar a pasear al menor cualquier día de la semana. Sin embargo, el 18 de diciembre de 2009 Janet Nieri Villareal se llevó al menor a la ciudad de Henderson Nevada en los Estados Unidos de Norteamérica con el argumento de que solamente iba a pasar la navidad con su hermana y regresaría el 7 de enero de 2010, pero nunca regresó. En clara violación a nuestro acuerdo de divorcio no me dejo ningún dato para localizarla, pero investigué el domicilio y teléfono de dicha hermana, hablándole para pedirle explicación de su conducta, a lo que ella respondió groseramente que jamás regresaría y que nunca volvería a ver a mi hijo, tras lo cual colgó, después de negaron a contestar mis llamadas para luego cambiar el numero. Presenté un reporte a la policía de Henderson Nevada. Presento esta denuncia indicando como domicilio la calle 1000 American Pacific Drive Rd suite 514. Después de reportarlo a la policía ella habló solo una vez desde el numero 702 207 0487 para insultarme por haberla reportado. Ella es originaria de las Filipinas y naturalizada mexicana.

On April 7, 2003 I contracted marriage with Janet Nieri Villareal, during which we procreated a son of name Miguel Angel Rivera Villareal, but date of August 28, 2009 caused record request for voluntary divorce we promoted, in which she retains custody of the child and both share homeland powers have I the right to coexistence, visit and carry the child along with me any day of the week. However, on December 18, 2009 Janet Nieri Villareal took the child to the city of Henderson Nevada in the United States of North America with the argument that she was only going to spend Christmas with her sister and would return on 7 January 2010, but never returned. In clear violation of our agreement to divorce she did not leave me any data to locate them, but I researched the address and phone of the sister, asking her for explanation of her conduct, to which she responded rudely that he would never return and that I would never again see my son, whereupon hung, after refused to answer my calls to then change the number. I presented a report to the police from Henderson Nevada. I submit this complaint indicating as home Street 1000 American Pacific Drive Rd suite 514. After reporting to the police she spoke only once since the number 702 207 0487 to insult me by having reported her. She is from the Philippines and naturalized Mexican.
