In relation to the notice of complaint submitted by you in this Committee, which was given Not in dossier CNDH/5/2011/8536/Q, it has been determined, based on the provisions in the article 36 of the Act of the Commission on human rights, accept the instance, so it will immediately begin investigation and corresponding procedures.

I must inform you that according to article 32 of the above-mentioned law, the formulation of its complaint to this body not affects the exercise of other rights and means of defence may be available to the aggrieved conforms to the law, and not suspended or interrupted any time.

Also, in terms of provisions of articles 77 and 97 of the rules of procedure of the Commission, all our services are free of charge and it is not essential that represents it any lawyer.

Under the terms of the envisaged in the article 18 of the rules of transparency and access to the information of the NHRC, the procedure for access to information sustanciará as set forth in the chapter III of the title second Federal law of transparency and access to public government information, with the modalities established such regulation. Likewise, the treatment of information or personal data from individuals that make up the record of complaint, including the provision of information to third parties that so request, is subject to the provisions of the Act and the regulations.

In accordance with the provisions of article 6 of the Mexican Constitution, 6 of the Federal law of transparency and access to public information NGO and 9 of the regulation of access to information of the NHRC, all information in the possession of the CNDH is public and can only be temporarily reserved for reasons of public interest in the terms set by law.

The personal data which the Commission receives from you will be handled for the exclusive purpose of identification and you will deal them confidentially.

En relación con el escrito de queja presentado por usted en esta Comisión, al que se le asignó el No de Expediente CNDH/5/2011/8536/Q, se ha determinado, con base en lo dispuesto en el articulo 36 de la Ley de la Comisión de los Derechos Humanos, admitir la instancia, por lo que de inmediato se iniciarán la investigación y los trámites correspondientes.

Le comunico que de acuerdo al artículo 32 de la citada ley, la formulación de su queja ante este organismo NO AFECTA EL EJERCICIO DE OTROS DERECHOS y medios de defensa que puedan corresponder al agraviado conforma a la ley, y no suspende ni interrumpe plazo alguno.

Asimismo, que en los términos de lo dispuesto en los artículos 77 y 97 del Reglamento Interno de la CNDH, todos nuestros servicios son gratuitos y no es indispensable que lo represente algún abogado.

En los términos de los previsto en el articulo 18 del reglamento de Transparencia y Acceso a la Información de la CNDH, el procedimiento de acceso a la información se sustanciará conforme a lo establecido en el capitulo III del titulo segundo de la Ley Federal de Transparencia y Acceso a la Información Pública Gubernamental, con las modalidades que establece dicho reglamento. Asimismo, el tratamiento de información o datos personales de particulares que integran el expediente de queja, incluso el suministro de información a terceros que así lo soliciten, se encuentra sujeto a las disposiciones de la ley y el reglamento.

De conformidad con lo dispuesto por los artículos 6 de la Constitución Mexicana, 6 de la Ley Federal de Transparencia y Acceso a la Información Publica Gubernamental y 9 del reglamento de acceso a la información de la CNDH, toda información en posesión de la CNDH es pública y solo podrá ser temporalmente reservada por razones de interés público en los términos fijados por las leyes.

Los datos personales que la CNDH reciba de Ud. serán manejados con fines exclusivos de identificación y se les tratará confidencialmente.
